The appellant failed to demonstrate on the balance of probabilities, through sufficiently precise and unambiguous evidence, that the building was lawfully used as 19 self-contained flats during the relevant period, as the removal of kitchen facilities and provision of communal catering facilities constituted a material change of use to a hostel/mixed residential use.
