What decided it

Planning committee members were entitled to apply greater weight to the less than substantial heritage harm to a nationally important designated heritage asset than the case officer, and this exercise of planning judgement does not constitute unreasonable behaviour warranting a costs award.

The planning committee applied great weight to the conservation of Torrisholme Barrow as a nationally important designated heritage asset and found that the less than substantial heritage harm and conflict with the development plan were not outweighed by the public benefits, thereby disengaging the tilted balance and refusing permission.
