What decided it
The failure to secure with certainty appropriate mitigation for phosphate nutrient loading effects on the River Itchen SAC, in the absence of a completed Section 33 agreement with Eastleigh Borough Council, meant the proposal could not be approved under the Habitats Regulations.
Although the Council cannot demonstrate a five-year housing land supply and the proposal would deliver homes tailored for older people with economic benefits, the strong protection afforded to habitat sites by the Framework (paragraph 195) means the presumption in favour of sustainable development does not apply, and the benefits do not outweigh the conflict with the development plan.
