Main issues, as the Inspector framed them
- The effect of the proposal on the character and appearance of the area
- The effect of the proposal on the living conditions of neighbouring occupiers, with particular regard to privacy impacts
- Whether the proposal would have a satisfactory impact upon the highway network in respect of making adequate provision for highways infrastructure, with particular regard to the A27
- Whether the proposal would provide adequate mitigation for the Chichester and Langstone Harbours Special Protection Area (SPA), with particular regard to recreational and nitrates impacts
What decided it
The securing of the highway contribution of £47,440 through the unilateral undertaking in accordance with the 2024 SPD, combined with the SPA mitigation measures, enabled the appeal to succeed despite the Council's reasons for refusal.
The benefits of residential development within the settlement boundary, combined with the provision of adequate mitigation for highways and SPA impacts through planning obligations, outweighed any concerns about the scale and density of the development.
