The proposal would adversely affect the integrity of the Chiltern Beechwoods SAC without mitigation, which disapplies the tilted balance presumption in favour of sustainable development under paragraph 188 of the Framework.
The tilted balance under paragraph 11d of the Framework (triggered by the Council's inability to demonstrate a five-year housing land supply) was disapplied by paragraph 188 because the proposal would likely have a significant effect on a habitats site without an Appropriate Assessment concluding no adverse effect on integrity.
