What decided it

The Inspector could not be satisfied that all three derogation tests under the Conservation of Habitats and Species Regulations 2017 would be met, particularly the test requiring imperative reasons of overriding public interest, and therefore could not be confident that Natural England would grant the necessary Bat Low Impact Class Licence.

The proposed development would accord with the development plan but the material consideration of compliance with the Conservation of Habitats and Species Regulations 2017 indicated that a decision should be made contrary to the development plan.
