What decided it
The inability to rule out adverse effects on the integrity of the Arun Valley habitat sites due to insufficient certainty that water neutrality would be achieved, which engaged the habitat sites exception in NPPF paragraph 11(d)(i) and prevented the tilted balance from applying.
The significant shortfall in five-year housing land supply would normally trigger the presumption in favour of development under NPPF paragraph 11(d), but this was disapplied by the habitat sites protection policy exception, and the conflicts with the development plan spatial strategy and harm to character and appearance could not be outweighed.
