Main issues, as the Inspector framed them
- Appeal A: Whether the two outbuildings are required for purposes incidental to the enjoyment of the dwellinghouse as such, and whether they comply with the restrictions in Schedule 2, Part 1, Class E of the Town and Country Planning (General Permitted Development) (England) Order 2015.
- Appeal B: Whether temporary use of the eastern outbuilding to provide living accommodation during construction of the new dwelling is justified.
- Appeal C: The effect of the workshop and change of use of land to residential curtilage on (i) the character and appearance of the application site and its surroundings and (ii) the Local Wildlife Site.
What decided it
Appeal A: The southern outbuilding's measured height of 4.02 metres exceeds the fixed 4-metre limit in Class E.1(e)(i), and the eastern outbuilding provides self-contained residential accommodation which is not incidental to dwellinghouse enjoyment. Appeal B: The new dwelling's construction is now complete, making temporary accommodation no longer justifiable. Appeal C: The workshop and residential curtilage change of use represent harmful countryside encroachment contrary to Policy GBR2 and would cause further harm to the designated Local Wildlife Site.
