Main issues, as the Inspector framed them
- whether condition 6 is necessary having regard to the privacy of the occupiers of Granville House
- whether, having regard to the Act and Planning Policy Guidance, the local planning authority was able to attach condition 6 to the permission
What decided it
The separation distance of approximately 12m between the bedroom window and the side boundary, combined with the limited daytime use of bedrooms and the protection afforded to the highest amenity areas of the garden by existing screening and boundary treatments, meant that overlooking would not be harmful to privacy.
