Main issues, as the Inspector framed them

  • Appeal A: whether the laying of hardstanding in the form of brick paving, pillars, entrance gates, and formation of access track are immune from enforcement action as operations completed more than 4 years before the application date
  • Appeal B: whether retrospective planning permission should be granted for erection of stables and change of use from agricultural to equestrian use, with particular regard to Green Belt policy and biodiversity net gain

What decided it

Appeal A succeeded in part because the hardstanding and entrance features were evidenced to have been completed in 2012, beyond the 4-year enforcement period, but failed regarding the access track which was reformed after 2019. Appeal B succeeded because the equestrian use does not conflict with Green Belt policy and the statutory biodiversity net gain requirement does not apply to retrospective applications made before 12 February 2024.
