What decided it
The adverse effect on the integrity of the Arun Valley Protected Sites due to increased water abstraction, combined with harm to ecology and biodiversity on the site, engaged the exception in footnote 7 to paragraph 11(d) of the Framework and provided a strong reason for refusal.
Although the presumption in favour of sustainable development was engaged due to the lack of five-year housing land supply, the harm to the Arun Valley Protected Sites and ecology and biodiversity were the prevailing considerations, and the exception in footnote 7 to paragraph 11(d) applied, removing the need to undertake the balancing exercise in paragraph 11(d)(ii).
