Main issues, as the Inspector framed them

• Appeal A: the effect of the development on the character and appearance of the area; and highway safety with particular reference to the disposal of surface water from the site.
• Appeal B: the effect of the development on the living conditions of occupiers of neighbouring properties, with particular reference to privacy, noise and disturbance in relation to the occupiers of 49 Ferney Field Road and within the site; and highway safety with particular reference to off-street parking provision to meet the operational needs of the holiday let.

What decided it

Appeal A was allowed because the extensions accord with the development plan and the parking provision, whilst changing the character of the frontage, is not unduly harmful given similar alterations elsewhere on the road and can be adequately drained by condition. Appeal B was dismissed because the holiday let would cause unacceptable harm to the privacy and living conditions of neighbouring occupiers through intervisibility and noise and disturbance from increased movements, which cannot be adequately mitigated.

Appeal A: the development accords with the development plan and the Framework; no material considerations outweigh this finding. Appeal B: the limited benefits of the holiday let (local economic uplift) do not outweigh the harm caused to the living conditions of neighbouring and future occupiers.
