The conflict with development plan policies protecting public houses was attributed significant weight and outweighed the modest benefits of investment, job creation and reduced anti-social behaviour; the interference with the appellant's business was found to be lawful and proportionate in pursuit of the legitimate public interest aim of resisting unjustified loss of public houses as valued community facilities.
