Main issues, as the Inspector framed them

  • Whether or not residential use on the appeal site would represent an appropriate land use having regard to its existing status as a Scattered Business Site

What decided it

The appellant failed to undertake appropriate marketing of the site for sale, and consequently did not clearly demonstrate that re-use for employment-generating uses is no longer practicable, which is required by Policy DM5 of the development plan.

The moderate weight afforded to housing supply benefits and other benefits was significantly and demonstrably outweighed by the significant weight afforded to the harm from loss of employment land on an existing Scattered Business Site
