What decided it

The appellant failed to demonstrate that there are no reasonably available sites appropriate for the proposal with a lower risk of flooding, meaning the sequential test failed and the proposal conflicts with Framework paragraph 174 and JLP Policy LP27.

The substantial benefits of housing delivery, brownfield regeneration and town centre revitalisation were outweighed by the substantial harm from direct conflict with Government flood risk policy and the failure of the sequential test.
