- The main issue is whether the primary education contribution sought by GCC is necessary and reasonable in all respects.
What decided it
The Inspector's recalculation of the primary education contribution as necessary and CIL Regulation 122 compliant, combined with the benefits of the scheme (including housing delivery in an area without a five-year housing land supply) clearly outweighing the limited identified harms.
The limited landscape/visual harm and very limited heritage harm to nearby designated assets were outweighed by the public benefits of the scheme, including housing delivery (40% affordable) in an area lacking a five-year housing land supply, and economic and environmental benefits, resulting in no conflict with the development plan as a whole.
