Main issues, as the Inspector framed them
- whether future occupiers of the proposed development would be provided with adequate living conditions, with particular regard to private garden space and outlook
- the effect of the proposed development on the living conditions of the occupiers of No 77 Brougham Road, with particular regard to privacy, outlook and private garden space
- the effect of the proposed development on the character and appearance of the surrounding area
What decided it
The inadequate private garden space and outlook for future occupiers, combined with unacceptable intrusiveness and noise disturbance to the occupiers of No 77, means the adverse impacts significantly and demonstrably outweigh the housing benefits under paragraph 11(d) of the Framework.
The modest social and economic benefits of housing delivery and environmental benefits of solar panels were outweighed by the significant adverse impacts on the living conditions of both future occupiers (inadequate garden and outlook) and existing occupiers of No 77 (intrusiveness and disturbance), with paragraph 135(f) of the Framework being decisive.
