The Council's reasons for refusal, although not ultimately accepted on their planning merits, were matters of legitimate planning judgment and not so lacking in merit as to be unreasonable.

In relation to Queens Square, some less than substantial harm to the significance of the Shopping Building was outweighed by public benefits, and the loss of 'The Point' as a non-designated heritage asset was found to be justified by public benefits.
