Main issues, as the Inspector framed them
- the effect of the proposal on the living conditions of neighbouring occupiers of 327 Sandbanks Road with particular regard to outlook and privacy
- the effect of the proposal on the character and appearance of the area
- whether the proposal would be likely to have a significant effect on the integrity of the Dorset Heathlands, including the Special Protection Area (SPA) and the Dorset Heaths Special Area of Conservations (SAC), and the Poole Harbour SPA
What decided it
The Council's inability to demonstrate a five-year housing land supply, combined with the significant weight given to the net gain of five dwellings, outweighed the great weight attributed to the harm to neighbouring outlook when assessed against the Framework as a whole.
The great weight given to the adverse impact on the living conditions of neighbouring occupiers of No.327 does not significantly and demonstrably outweigh the significant weight given to the housing land supply benefits and the great weight given to the efficient use of land within an existing settlement for new homes, therefore the presumption in favour of sustainable development applies.
