What decided it
The absence of an executed section 106 agreement to secure the required SAMM and SANG mitigation measures meant the Inspector could not rule out adverse effects on the Thames Basin Heaths SPA habitat site, which provided a strong reason for dismissal under the habitat regulations.
The benefits of housing delivery, reuse of previously developed land, local economic benefits, and environmental improvements from energy efficiency and biodiversity enhancement were outweighed by the harmful loss of an employment site and the unmitigated harm to the Thames Basin Heaths SPA habitat site.
