What decided it
The defective Unilateral Undertaking meant the public benefits of the proposal could only be given limited weight, which was insufficient to outweigh the less than substantial harm to the Conservation Area when great weight must be attributed to its conservation under the Framework.
The benefits of housing delivery and the lack of alternative sites within the village were outweighed by the less than substantial harm to the Conservation Area, to which great weight must be given under the Framework, particularly given the failure to secure affordable housing and elderly persons accommodation through a defective legal mechanism.
