Main issues, as the Inspector framed them

  • Whether the appeal site would be a suitable location for tourist holiday accommodation with regard to local and national policies
  • Whether the proposal makes appropriate mitigation measures for the adverse impact on the integrity of the Cannock Chase Special Area of Conservation (the 'SAC')

What decided it

The lack of an executed legal agreement to secure the required financial mitigation for the adverse impact on the Cannock Chase SAC integrity meant the proposal could not be approved under Framework policy N6:1.a.i, causing the benefits to be substantially outweighed by adverse effects.

Applying policy S5:1, the benefits of the small-scale rural tourism proposal, including support for the local economy and the Council's tourism objectives, would be substantially outweighed by the adverse effects arising from the unmitigated impact on the integrity of the Cannock Chase SAC due to the lack of an executed legal agreement.
