The failure to secure appropriate mitigation for nitrogen discharges to Poole Harbour SPA and Ramsar site, which would cause moderate harm to the protected sites and trigger the exception in footnote 7 to paragraph 11d)i of the Framework, preventing the tilted balance from applying.
The modest benefit of additional housing supply and construction employment, given substantial weight, was outweighed by the substantial weight given to the moderate harm to the Poole Harbour SPA and Ramsar site from unmitigated nitrogen discharges and the substantial weight of the Framework conflict, with the presumption in favour of sustainable development not applying due to the likely adverse effect on habitats sites.
