The failure to secure the required mitigation measures for the Dorset Heathlands and Poole Harbour Special Area of Conservation through a properly executed legal agreement, combined with the unacceptable quality of accommodation for future occupants, outweighed the moderate benefits of providing additional housing.
The moderate weight afforded to the provision of 6 additional dwellings and associated housing benefits did not outweigh the substantial weight given to the harm arising from failure to provide acceptable quality of accommodation and the failure to safeguard protected habitat sites, particularly given the Framework's strong protection for such sites
