What decided it
The proposal would adversely affect the integrity of the Chilterns Beechwoods SAC because the unilateral undertaking failed to secure the full mitigation contributions required, and regulation 63(5) of the Conservation of Habitats and Species Regulations 2017 has a determinative implication that the scheme could only be approved if it would not adversely affect the integrity of the SAC.
The substantial benefits of housing delivery in a district with severe supply shortage and other benefits from construction, local spending, sustainable construction and biodiversity enhancements outweighed the loss of the locally listed building taken in isolation, but the harm to the integrity of the SAC provided a strong reason for refusal that the material considerations could not overcome.
