Land At Liverpool Road, Backford , Chester, CH2 4BE

erection of two 3 block of stables and two 2 block stables with hardstanding. There should be no change of use for this land as it stated in the legal pack the land is used for agricultural, grazing or equine. The work to be carried out is to put 2x 3 block of stables and 1x 2 block of stables all on hard standing to avoid subsidence of stables, also some of the horses have medical conditions which needs them to be off wet / muddy fields. Hard standing is also for the use of veterinary care and also for the farrier to attend their needs. There is also going to be a field shelter on natural standing. I will also have to erect a shelter for hay and straw and a base for a muck heap

Main issues, as the Inspector framed them

  • Whether the proposal would be inappropriate development in the Green Belt, having regard to policies in the development plan and the National Planning Policy Framework
  • The effect of the proposal on the character and appearance of the countryside
  • The effect of the proposal's access arrangements on highway safety
  • If the proposal is inappropriate development in the Green Belt, whether the harm by reason of inappropriateness and any other harm is clearly outweighed by other considerations so as to amount to the very special circumstances necessary to justify the development

What decided it

The very substantial weight given to the health and well-being benefits for the family members and the welfare needs of the horses, particularly those with medical conditions requiring shelter from muddy fields, clearly outweighed the substantial Green Belt harm.
