Main issues, as the Inspector framed them

  • Appeal A: whether the proposed development would be appropriately located having regard to development plan Policies
  • Appeal B: whether the proposed development would be appropriately located having regard to development plan Policies, and the effect of the proposed development on the character and appearance of the area

What decided it

The Council's inability to demonstrate a five-year housing land supply, which triggered the tilted balance under NPPF paragraph 11(d), and the conclusion that the benefits of housing supply and economic benefits significantly and demonstrably outweighed the conflict with Policies SS1 and SS6.

The conflict with Policies SS1 and SS6 was afforded limited weight due to the out-of-date development plan and housing land supply shortfall; the proposed development's contribution to housing supply and local economic benefits were afforded significant weight and outweighed the limited weight given to policy conflict.
