Main issues, as the Inspector framed them

  • Whether the breach of planning control was substantially completed more than four years before the enforcement notice was issued (ground (d))
  • Whether the steps required by the enforcement notice exceed what is necessary to remedy the breach of planning control (ground (f))
  • Whether the period for compliance with the enforcement notice is reasonable (ground (g))

What decided it

The enforcement notice's requirement for total removal was excessive because the appellant has a realistic fallback position under permitted development rights to reduce the boundary treatments to 1m in height, making modification a less disruptive remedy that would achieve essentially the same outcome.

Balancing public and private interests, the Inspector found that allowing reduction to 1m height rather than total removal would remedy the breach without leaving the site unenclosed, and that three months rather than two months was a reasonable compliance period given the specialised nature of the works.
