The appellant failed to provide sufficiently precise and unambiguous evidence that the change of use from C3 to C4 HMO had occurred before the Article 4 Direction came into effect on 17 June 2021, as the key documentary evidence (AST, HMO licence application, Building Control inspection) all post-dated the relevant date and contained material discrepancies.
