What decided it
The genuine fallback position of the prior approval, combined with the Council's failure to demonstrate five-year housing land supply and the proposal's superior design and self-build benefits, meant the adverse impacts of the location conflict did not significantly and demonstrably outweigh the benefits under paragraph 11(d)(ii) of the Framework.
The adverse impacts of the proposal's location outside the settlement boundary and conflict with spatial strategy policies were afforded limited weight given the rural context and fallback position; the benefits of housing delivery (moderate weight), self-build provision (moderate weight), and renewable energy measures (moderate weight) were not significantly and demonstrably outweighed, engaging the presumption in favour of sustainable development.
