The Council did not deny the fallback position and clearly articulated in its refusal reason that it was objecting to the loss of a property capable of providing either a C3 single dwellinghouse or C4 smaller HMO, therefore unreasonable behaviour resulting in unnecessary expense was not demonstrated.
