Main issues, as the Inspector framed them
- whether the development would be required to provide financial contributions towards affordable housing, local infrastructure and to mitigate any impact on the integrity of the Burnham Beeches Special Area of Conservation (SAC), and if so whether a suitable mechanism to secure that has been provided
- the effect of the proposal on the character and appearance of the area
- whether the proposal would prejudice the future development of adjacent land
What decided it
The failure to complete a s.106 agreement to secure affordable housing, education, open space and SAC mitigation contributions meant the development could not proceed without conflicting with the development plan.
The substantial benefits of housing delivery (addressing a 2.5-year supply shortfall), town centre location, and economic benefits were outweighed by the conflict with the development plan arising from the absence of a completed mechanism to secure required contributions and ecological mitigation.
