Main issues, as the Inspector framed them
- Whether planning permission should be granted for the unauthorised demolition of garages and erection of a single-storey rear extension, having regard to the impact on the living conditions of adjoining residential properties in terms of noise, odour and general disturbance
What decided it
The retractable roof, required to facilitate shisha smoking, creates an incompatible use adjacent to noise-sensitive residential properties with unacceptable impacts on living conditions in terms of noise, odour and general disturbance, which cannot be adequately mitigated by conditions and conflicts with development plan policies.
The benefits of improved visual appearance and moderate economic benefits do not outweigh the significant harm to the living conditions of neighbouring residential properties caused by noise, odour and disturbance from the shisha bar and restaurant use facilitated by the extension.
