What decided it

The fence exceeds the one-metre height limit in GPDO Schedule 2 Part 2 Class A paragraph A.1(a)(ii) for structures adjacent to highways used by vehicular traffic, and no express planning permission was granted, therefore constituting a breach of planning control.
