What decided it

The appellant failed to demonstrate on the balance of probability that the use as two small HMOs benefited from permitted development rights under Part 3, Class L of the GPDO, as the evidence did not support that the premises had been substantially completed as three flats in accordance with the 2019 permission before conversion to HMOs.
