Main issues, as the Inspector framed them
- Whether condition 4 restricting operating hours to 07:00 to 21:00 each day is necessary and reasonable, having regard to the living conditions of occupants of nearby properties
What decided it
The technical noise evidence, supported by the Council's own acoustic consultant and an earlier Inspector's findings on a similar scheme, demonstrated that the development would not cause unacceptable adverse effects on neighbouring residential properties without the operating hours condition, and the remaining mitigation measures were sufficient.
