What decided it
The Inspector found that the appellant had not proved the property was ever lawfully converted into two flats, and that the resulting HMO use caused substantial, unmitigated harm to character, living conditions and neighbouring amenity which was not outweighed by the fallback position or Article 8 considerations.
the combined weight of harm to character, occupants' living conditions, neighbours' living conditions and sustainable transport was substantial and was not outweighed by the limited, non-comparable fallback position or by Article 8 interference with occupants' home life, so permission was refused
