What decided it

The failure to secure mitigation for likely significant effects on the Thanet Coast and Sandwich Bay Special Protection Area through a legal agreement, combined with the protection afforded to the SPA under Footnote 7 to NPPF paragraph 11, which provides a strong reason for refusing the proposal.

Under NPPF paragraph 11(d)(i), the protection of the Special Protection Area as an area of particular importance provided a strong reason for refusal, and the identified harms to character and appearance and living conditions were consistent with Framework policies and carried weight; the benefits of housing provision and self-build did not outweigh these harms.
