Main issues, as the Inspector framed them
- The effect of the advertisement on amenity, with particular regard to the character and appearance of the area and the living conditions of the occupiers of neighbouring properties; and any other relevant factors, including the condition of the building and its effect on the character and appearance of the area; and the temporary nature of the advertisement and whether the period proposed is justified having regard to the marketing activity and regeneration prospects of the site.
What decided it
The harm to amenity from the advertisement was appreciably less than the harm that would result from its removal, given the funding link between the advert and the maintenance of the shroud and genuine ongoing marketing/regeneration prospects.
the harm to amenity caused by the advertisement was appreciably less than the harm that would occur to the character and appearance of the area if the advert (and the shroud it funds) were removed, so the balance favoured allowing the appeal
