What decided it

The substantial loss of privacy caused to the occupants of 58 Birdhill Avenue by the elevated land raising and hardstanding, which created extensive overlooking of their rear garden and patio, was not capable of adequate mitigation and constituted unacceptable harm that could not be outweighed.
