Main issues, as the Inspector framed them
- The effect of the proposed development on the living conditions of the occupiers of 35, 37 and 39 Lower Cippenham Lane with regards to privacy, noise and disturbance, the outlook from No 35 and the provision of outdoor space for Nos 35 and 37
- Whether the development would provide sufficient private outdoor space for the occupiers of the proposed houses
- Whether it would make sufficient provision for biodiversity net gain
- Whether it would provide safe and adequate vehicular access
- Whether it would provide adequate on-site parking
- Whether it would provide adequate arrangements for bin storage and collection
- The effect on the character and appearance of the area
- Whether it would provide safe access for pedestrians to the highway
What decided it
The unacceptable harm to the living conditions of occupiers of Nos 35 and 37 through loss of privacy, combined with inadequate living conditions for future occupiers and highway safety concerns, substantially and demonstrably outweighed the benefits of delivering four new homes in an area with acute housing need.
The considerable weight given to the delivery of four new homes in a borough with only 2.2 years' housing land supply and housing delivery shortfall, together with moderate weight for economic benefits, was substantially and demonstrably outweighed by unacceptable harm to neighbouring living conditions, inadequate future occupier amenity space, highway safety risks, and failure to demonstrate biodiversity net gain.
