What decided it

The pre-development works, particularly the dwarf wall and timber cladding which fully enclosed a previously partially open elevation, constituted material development under section 55 of the TCPA and triggered the restriction in paragraph Q.1(g)(ii) of the GPDO, removing permitted development rights.
