Main issues, as the Inspector framed them
- whether suitable living conditions could be achieved for future occupiers of the proposed dwellings with respect to odour
- whether the development would be inappropriate development in the Green Belt having regard to the Framework and any relevant development plan policies
- the effect of the proposal on designated heritage assets
What decided it
Uncertainty as to whether suitable living conditions with respect to odour from the adjacent Waste Water Treatment Works could be achieved for future occupiers of the proposed dwellings.
The substantial benefits of housing and affordable housing delivery, Golden Rules compliance, and moderate/limited weight benefits (economic, open space, biodiversity net gain, highway improvements) were substantially outweighed by the adverse effects of the proposal, principally unresolved odour impacts on future occupiers, so the presumption in favour of sustainable development did not apply.
