Main issues, as the Inspector framed them

  • the effect of the development on the living conditions of existing and future occupiers with particular regards to overlooking and privacy

What decided it

The relationship between the upper floor rear window of the host dwelling and the appeal proposal would not result in harmful levels of overlooking and loss of privacy to future occupiers, and the Council's inability to demonstrate a five-year housing land supply meant the presumption in favour of sustainable development applied and was not substantially outweighed by adverse effects.

The Council's acute deficit in five-year housing land supply (2.1 years) engaged the presumption in favour of sustainable development under Policy S4; the proposal would accord with the national decision-making policies in the Framework and would not result in harm to privacy of future occupants or accord with the development plan, such that the benefits of approval would not be substantially outweighed by any adverse effects.
