Main issues, as the Inspector framed them

  • Whether the development would provide satisfactory living conditions for its occupants with particular regard to internal living space and outlook

What decided it

The proposal's failure to comply with the explicit design standards set out in Local Plan Policies H10 and EN4 regarding internal living space and outlook, assessed against Policy DP3 of the Framework, meant the benefits would be substantially outweighed by adverse effects under Policy S4.

The benefits of reusing a vacant building and providing a dwelling, attracting substantial weight, were substantially outweighed by the significant adverse effects on living conditions through non-compliance with the NDSS and poor outlook, assessed against Policy S4(1) and (2)c of the Framework.
