Main issues, as the Inspector framed them
- Whether the location, land use and amount of development would be acceptable with particular reference to designated habitats sites
- Whether the location, land use and amount of development would be acceptable with particular reference to policies for development in the Green Belt
What decided it
The failure to secure full and adequate mitigation for likely significant effects on the Chilterns Beechwoods SAC through the Unilateral Undertaking, which breached the mandatory duty under Regulation 63(5) of the Conservation of Habitats and Species Regulations 2017 and Article 5B of the Permission in Principle Order.
The benefits of housing delivery and support to local services, attracting full weight, were substantially outweighed by the breach of the habitats regulations and the harm to the designated habitats site, which attracted weight of a very high order.
