Main issues, as the Inspector framed them
- For Appeals A, B, K, L, M, P, Q, R and S: whether the proposals would preserve or enhance the character or appearance of the Conservation Area and nearby listed buildings, the effect of the proposals on the amenity of the area and public safety, and the effect of the proposals on crime and anti-social behaviour.
- For Appeals C, D, E, F, G, H, I and J: the effect of the proposals on the character and appearance of the area, the effect of the proposals on the amenity of the area and public safety, and the effect of the proposals on crime and anti-social behaviour.
- For Appeals N and O: whether the proposals would preserve or enhance the character or appearance of the Conservation Area, the effect of the proposals on the amenity of the area and public safety, and the effect of the proposals on crime and anti-social behaviour.
What decided it
The unmitigated risk that the Street Hub Units and advertisement panels would fall into disrepair, absent any enforceable mechanism to secure their maintenance, leading to significant harm to the character, appearance and, in several cases, heritage setting of the surrounding areas, which outweighed the limited benefits claimed.
The moderate weight given to the claimed public/digital benefits of the Street Hub Units did not outweigh the significant harm found to visual amenity, character and appearance, and in some cases heritage assets, so the balance fell against the proposals in every appeal.
