Main issues, as the Inspector framed them

  • whether the statutory BNG requirements would apply to the proposal and, if so, whether they would be met
  • whether the proposal would be inappropriate development in the Green Belt having regard to the Framework and relevant development plan policies

What decided it

The proposal would fail to comply with the statutory biodiversity net gain requirement in Schedule 7A of the Town and Country Planning Act 1990 because it could not be secured as self-build development and there was no evidence of the site's pre-development biodiversity value.

The benefits of the proposal, comprising limited housing contribution, economic benefits and design preferences, would be substantially outweighed by its adverse effects when assessed against the Framework's national decision-making policies, particularly the conflict with Framework policy N2(1)(a) on biodiversity conservation and enhancement.
