Main issues, as the Inspector framed them

  • Appeal A: the effect of the proposed Hub on the character and appearance of the area
  • Appeal B: the effect of the proposed advertisement on the visual amenity of the area

What decided it

The bulky size and visual prominence of the illuminated Hub structure, combined with its disruptive effect on the rhythm and spacing of existing street furniture, would cause substantial harm to the character and appearance of the area that could not be overcome by the telecommunications and public service benefits offered.

applying Policy S4 of the NPPF, the benefits of the proposal (wi-fi, public services, device charging, 4G/5G coverage, renewable energy, environmental sensors) were given substantial weight, but were substantially outweighed by the adverse effects on character, appearance and visual amenity, particularly the conflict with Policy DP3 requiring substantial weight to be given to compliance with relevant development plan policies on design quality
