What decided it

The failure to demonstrate compliance with the statutory biodiversity net gain requirements of Schedule 7A of the Town and Country Planning Act 1990, as the development could not be secured as a self-build dwelling and no BNG information was provided.

The small economic benefits from construction activity were afforded only limited weight and could not overcome the statutory requirement to demonstrate compliance with the biodiversity gain objective; consequently the appeal was dismissed.
